CRADLE Copyright Notice

1. Ownership​

Copyright and other rights in the proprietary CRADLE compiler, assembler and associated original implementation materials are owned or lawfully controlled by National Cybersecurity R&D Lab (NCL), except where another rights holder is expressly identified.

CRADLE proprietary materials may include:

  • source code
  • object code and executable binaries
  • original implementation documentation
  • architecture documentation and diagrams
  • original specifications
  • CRADLE-owned SDK components, libraries, schemas and templates
  • original website and documentation content
  • other copyright-protected expression supplied as part of CRADLE

Ideas, concepts, methods, systems, functionality and algorithms are protected only to the extent provided by applicable law. This Notice does not claim copyright over matters that are not protected by copyright.

2. Proprietary Status​

The CRADLE compiler, assembler and associated proprietary implementation materials are proprietary software.

The Software is licensed, not sold. Downloading, accessing, installing, executing or possessing the Software does not transfer copyright or ownership.

All rights not expressly granted under an applicable licence or written agreement are reserved.

3. Scope​

This Notice applies only to CRADLE-owned or lawfully controlled materials.

It does not replace or override:

  • third-party copyright notices
  • third-party software licences
  • release-specific terms
  • licence schedules
  • contributor agreements
  • separately executed written agreements

Where a component identifies another copyright owner or licence, the terms identified for that component apply.

4. Independent Plugins​

Copyright and other rights in independently developed Plugin code remain with the Plugin's author or other lawful rights holder unless otherwise agreed in writing.

An independent Plugin does not become NCL property solely because it:

  • uses documented CRADLE syntax
  • consumes or produces a documented CRADLE Intermediate Representation
  • communicates through a documented CRADLE API or plugin interface
  • integrates CRADLE with a cyber range, testbed or other system
  • processes output generated by CRADLE

A Plugin owner may select a lawful licence for independently authored Plugin code, subject to any licence obligations applying to CRADLE-owned or third-party material incorporated into the Plugin.

5. CRADLE Development Materials​

CRADLE-owned SDK components, libraries, templates, schemas and other development materials remain subject to the licence expressly identified for those materials.

Authorised use of CRADLE development materials does not, by itself, transfer ownership of independently authored Plugin code to NCL.

Any CRADLE-owned or third-party material copied, modified, incorporated or distributed as part of a Plugin remains subject to its applicable terms.

6. User-Created .cradle Files​

Unless otherwise agreed in writing, rights in independently authored .cradle files remain with their authors or other lawful rights holders.

Use of CRADLE to create, edit, validate, compile, assemble or process a .cradle file does not, by itself, transfer ownership of that file to NCL.

7. Generated Output​

Use of CRADLE does not, by itself, transfer ownership of independently generated configuration, deployment, script, data or testbed-specific output to NCL.

Where Generated Output contains CRADLE-owned code, templates, libraries, runtime components or third-party materials, those portions remain subject to their applicable copyright and licence terms.

8. Contributions​

Copyright in a contribution remains with its contributor or other lawful rights holder unless:

  • ownership is validly assigned
  • ownership belongs to another person under applicable law
  • an employment, contractor, research or institutional agreement provides otherwise
  • separate contribution terms apply

Nothing in this Notice alone transfers copyright in a contribution.

Contributors may be required to enter separate terms granting NCL sufficient rights to use, reproduce, modify, distribute, sublicense and incorporate their contributions into CRADLE.

9. Future Releases​

Copyright ownership and licensing are separate matters.

A future CRADLE release may use different licence terms where the relevant rights holder possesses authority to grant those terms.

A licence change for a future release does not, by itself, amend the terms governing an earlier release or transfer the underlying copyright.

Nothing in this Notice commits NCL to release CRADLE under any particular licensing model.

This Notice is intended to operate consistently with the Copyright Act 2021 of Singapore.

Relevant provisions include:

  • section 13, concerning works in which copyright may subsist
  • sections 133 and 134, concerning first ownership
  • sections 137 to 140, concerning transfers and assignments
  • section 153, concerning infringement proceedings
  • sections 238 to 240, concerning certain permitted uses of computer programs

Nothing in this Notice excludes a permitted use or other right that cannot lawfully be excluded or restricted.

11. Reservation of Rights​

Except for rights expressly granted under an applicable licence or written agreement, all rights in proprietary CRADLE materials are reserved.
